Background
The workshop was organised in partnership of the National Environment Management Authority (NEMA), Research Centre for European Environmental Law, “icipe - African Insect Science for Food and Health”, and the ABS Capacity Development Initiative for Africa. The workshop took stock of the first two years of implementation of the Kenyan ABS regulations as contained in the Environmental Management and Coordination (Conservation of Biological Diversity and Resources, Access to Genetic Resources and Benefit Sharing) Regulations, 2006. Practical experiences of relevant Kenyan stakeholders, lessons learned from the research project of FEU on the legal and socio-political aspects of ABS (for details see www.feu.uni-bremen.de/en/projects.html) and experiences with drafting and implementing ABS regulations of a few other African countries provided the background for a constructive analysis and discussion on the strengths and weaknesses of the Kenyan ABS regulations with the aim to identify the potentials for further improvement in the regulations to ensure that access for the benefit of conservation can still take place and that benefits are flowing back to Kenya in case of utilisation of genetic resources and associated traditional knowledge.
